By creating an account you enter into a contract with the person named in the Impressum, on these terms. They are short on purpose.
There is no tolerance for objectionable content or abusive behaviour on this network. Content that is hateful, harassing, sexual, violent, illegal, or that targets a person, is removed, and an account that posts it may be suspended or terminated. A single clear breach can be enough; how serious a step follows depends on how serious the breach was.
Post only photographs you made yourself and have the right to share. Do not post someone else's work, and do not post a coordinate that puts a person or a place at risk — a private home, a nest site, a fragile landscape.
Captions, comments, names and biographies pass an automatic word filter before they are posted. It refuses slurs, sexual content and links, and it tells you which rule it thinks you broke. It is deliberately blunt: it cannot read a photograph and it cannot recognise politely-worded harassment, so it is a first pass and not a judgement.
Everything else is decided by a person. Reports are read within 24 hours. No account is suspended or terminated by a machine.
Whenever something you posted is removed or made non-public, or your account is suspended or terminated, you get a statement of reasons: what was done, the facts it was based on, whether an automated tool was involved, and whether the ground was the law or these terms. You will find it under Profile → Account → Moderation.
You can object. Say why you think the decision was wrong and a person reads it and decides again — they can undo it. This is free and it does not take away your right to go to court, which you keep either way.
Use Report in the menu on any photograph, comment or profile. Tell us what is wrong and, if it helps, why. You get a confirmation at once and the decision by e-mail within 24 hours, with what you can do if you disagree with it.
Your photographs are yours. Posting one grants only what is needed to run the app: to store it, resize it, and show it to the people you chose to show it to — including through the hosting provider named in the privacy notice. That permission is non-exclusive, carries no fee, and ends when you delete the photograph or the account.
Everything here is free except one layer. Photoreal streams Google's photorealistic 3D tiles into the viewfinder, and every session of it costs money to serve, so it is a subscription: €2.99 per month, renewing until you stop it. Terrain, satellite, the light, the ephemeris, the map, the network and everything else stay free and always will.
The subscription is bought through the App Store, not from this app, so Apple takes the payment and Apple holds the contract for it. Cancel it the same way: Settings → your name → Subscriptions. Cancelling stops the next renewal and leaves the current period running; nothing else in the app changes when it ends.
Refunds are Apple's to give, at reportaproblem.apple.com. Because the subscription starts working the moment it is bought, the fourteen-day right of withdrawal under § 356(5) BGB ends once it has begun — that is the law for digital content that starts immediately, and Apple asks you to agree to it at purchase.
The Sun, Moon and horizon calculations are accurate to the models behind them, and the terrain is sampled from public elevation data — but a mountain is not a spreadsheet. Weather, conditions, access and your own judgement are yours. Do not walk into anywhere on the strength of a screen.
Liability is unlimited for intent and gross negligence, for injury to life, body or health, and wherever the Produkthaftungsgesetz applies. For simple negligence there is liability only for breach of an obligation whose fulfilment makes performing this contract possible at all and on which you may rely, and then only for the damage typically foreseeable for a contract of this kind. Nothing here limits liability where the law does not allow it to be limited.
If these terms change in a way that matters, you will be told in the app at least 30 days before the change takes effect, and told what changed. If you do not want the new terms, delete your account before then; that costs nothing and takes one tap.
You may delete your account at any time from Profile → Account, without giving a reason. An account may be suspended or terminated for a breach of these terms — with the statement of reasons and the objection described above, except where the law requires immediate action. Both sides keep the right to terminate for good cause.
German law applies. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country you live in. The German version of these terms is the one that governs; the other languages are translations offered for convenience.
